Terms and Conditions
1. Background
Kate Flower Food will develop recipes with local produce, to be used in her 2021 Christmas publication and any other business-related activity, in accordance with the Sponsorship Kit.
2. Product criteria
All products used in the publication will be grown or made in WA, ideally using Western Australian produce. The client warrants that the products supplied are grown or made in WA. Only one supplier per product type will be engaged by Kate Flower Food, to ensure exclusivity of supply. Final recipes and images developed by Kate Flower Food (“content”) will be provided by Kate Flower Food to the client on, or before, Tuesday 30th November 2021.
3. Licensing of Content
All recipes developed and/ or associated in any way with the client’s product are the intellectual property of Kate Flower Food. All images, including videos, of the client’s product and related recipes are the intellectual property of the photographer.
4. Permitted use of content
Subject to clause 5, Kate Flower Food provides a licence to the client to use any recipes and images (including videos) developed and/or produced for the purpose of promoting the product on the client’s social media platforms, website and in electronic direct mail (“permitted purpose”). The Client may share information on the Client’s website however, a copy of the publication A Local Table must only be accessed by direct download from Kate Flower Food’s website through the following url: www.kateflowerfood.com.au/alocaltable2021
The client may not use the recipes and images (including videos) for the purpose of advertising campaigns, however this may be negotiated at an additional cost.
5. Attribution
When using the content, creative credit must always be attributed with the correct references, for example: As featured in At Local Table by Kate Flower Food Recipe and Styling by Kate Flower @kateflowerfood Photography by [insert photographer]. The reference details for final use will be provided to the Client with the content on 30th November 2021. Recipes are created and developed by Kate Flower at her sole discretion.
6. Gourmet Giveaway Competition
On the back of last year’s success and as part of a comprehensive Marketing and PR strategic plan, Kate Flower Food will again be running a Gourmet Giveaway promotion (“promotion”). By purchasing a package in the 2021 A Local Table e-book publication, the client agrees to be included in this promotion. A donation of product or produce to the value of $100, or more, is required by all clients to be included in the promotion. Promoted on social media channels and with strategic alliances with some of Perth’s major lifestyle publications, participation in the Giveaway will help raise awareness of A Local Table and each supplier involved in the project.
All competition items must be delivered by 1st December, 2021, unless otherwise discussed. Delivery address to be confirmed via email. A dedicated Marketing and PR team working on this project to support the promotion of the e-book and the suppliers involved. Agreement A condition of participation in the 2021 A Local Table e-book publication is that all suppliers have read, understood and agreed to the above Terms and Conditions. Receipt of payment of the agreed amount (“agreed payment”), in accordance with the package selected in the Sponsorship Kit, for inclusion in A Local Table is confirmation of this agreement. 8. Cancellation The client acknowledges that Kate Flower Food will perform work and incur expenses in order to deliver recipes within the required timeframe. By way of notification in writing to Kate Flower Food, the client may cancel this agreement up to 20 days after this agreement begins, in accordance with clause
7. (“cooling-off period”).
After the expiry of the cooling off period, the client will have no ability to request the agreed payment be returned to them, except as permitted under the Australian Consumer Law.
Kate Flower Food is the business Kate Flower Food ABN 30 661 322 499. Client is you; the party entering into this agreement with Kate Flower Food. Sponsorship Kit is the publication signed by you, demonstrating your selection of the service/ product you choose to purchase from Kate Flower Food. Agreed amount is the amount paid by you based on your selection in the Sponsorship Kit, and paid to Kate Flower Food. Promotion is the Gourmet Giveaway promotion. Permitted Purpose is the purpose outlined is clause 5 or any other purpose which Kate Flower Food approves in writing. Content is the content developed by Kate Flower Food and delivered to the client on 30th November, 2021.
